<h2>Why Access to Justice Matters</h2>When people don't trust the courts, they avoid them even when they need them. Disputes go unresolved, rights go unenforced, and problems escalate. A trustworthy JP court means:• Families can address truancy issues with support rather than fear• Small businesses can collect legitimate debts• Tenants can hold landlords accountable for repairs and vice versa• Consumers can pursue lawful claims• Everyone can resolve disputes fairly without resorting to informal or potentially harmful alternatives<h2>Trust Is Fragile Right Now</h2>Some people are more scared right now of courts and government in general than they ever have been, especially in our community.Every El Pasoan needs access to these courts to resolve their legal issues. A justice of the peace is a local court that handles everyday matters: citations, landlord-tenant disputes, small claims, and truancy. Whenever people avoid the court because of the current climate or because they think the system can't help them, we can and should do better.<h2>Building Trust Through Action</h2>Trust is earned through consistent, transparent, and fair action. <h2>The Crisis We Face</h2>Schools across JP Precinct 1 are facing a critical moment when it comes to student attendance and the well-being of our children. The data tells a troubling story that demands our attention and action.<h2>The Numbers Are Alarming</h2>For instance, EPISD reported a&nbsp;37% chronic absenteeism rate in 2021-22—the highest for any public school district in El Paso County (<a href="https://elpasomatters.org/2024/12/10/episd-attendance-investigation-student-absence/" target="_blank" rel="noopener noreferrer">El Paso Matters, December 2024</a>).EPISD lost&nbsp;$25.9 million in state funding&nbsp;due to unexcused absences in 2024-25—money that could have supported our children (<a href="https://cbs4local.com/newsletter-daily/el-paso-schools-lose-out-on-259-million-in-funding-due-to-truancy-rates-texas-tx-independent-school-district-episd-isd" target="_blank" rel="noopener noreferrer">CBS4, August 2025</a>).In 2022, EPISD&nbsp;stopped sending absence notices for two months, breaking 'the key chain of communication between the school and the parent' (<a href="https://elpasomatters.org/2024/12/10/episd-attendance-investigation-student-absence/" target="_blank" rel="noopener noreferrer">El Paso Matters</a>).Statewide, approximately&nbsp;1 million Texas children are reported truant every year&nbsp;(2020-2024 school years) (<a href="https://www.click2houston.com/news/investigates/2025/02/25/tea-reviewing-truancy-data-following-kprc-2-investigation/" target="_blank" rel="noopener noreferrer">KPRC 2, February 2025</a>).Chronic absenteeism in Texas nearly doubled&nbsp;after the pandemic—from about 11% to over 25%—and still hasn't fully recovered (<a href="https://www.texasstandard.org/stories/chronic-absenteeism-texas-school-post-pandemic-covid-absences/" target="_blank" rel="noopener noreferrer">Texas Standard, August 2024</a>). El Paso County followed the same pattern (<a href="https://www.the74million.org/article/chronic-absenteeism-rises-in-texas-schools-post-pandemic/" target="_blank" rel="noopener noreferrer">The 74, April 2024</a>).13-14% of Texas school districts&nbsp;reported zero truancy prevention efforts in the last four years (<a href="https://www.click2houston.com/news/investigates/2025/11/13/kprc-2-investigates-finds-truancy-data-not-proactively-monitored/" target="_blank" rel="noopener noreferrer">KPRC 2, November 2025</a>).<h2>The Bigger Problem: Nobody's Tracking Outcomes</h2>Perhaps most concerning:&nbsp;no state agency tracks what happens to students after they're referred to truancy court&nbsp;(<a href="https://www.kxan.com/investigations/12000-texas-kids-sent-to-court-for-missing-class-no-one-tracks-what-happens-next/" target="_blank" rel="noopener noreferrer">KXAN, November 2024</a>). The Texas Education Agency confirmed it has 'no authority to require courts to provide data on the handling of truant conduct cases.' State lawmakers and education experts have expressed alarm at this lack of oversight. As one attorney put it, 'How can we make smart, informed policy decisions about whether these interventions are working?' when we have no data on outcomes. Legislation has been filed to address this tracking gap (<a href="https://www.kxan.com/investigations/new-texas-bill-could-unlock-mystery-of-what-happens-to-students-in-truancy-court/" target="_blank" rel="noopener noreferrer">KXAN, March 2025</a>).<h2>What's Behind the Absences</h2>Truancy isn't just about kids skipping school.&nbsp;Research shows chronic absence is often a canary in the coal mine—an early warning sign of deeper issues including homelessness, mental health struggles, lack of transportation, poverty, family crisis, bullying, or academic difficulties. Since the pandemic, families' attitudes about attendance have shifted, and schools are overwhelmed trying to address the root causes with limited resources.<h2>Where JP Courts Can Help</h2>Since Texas reformed truancy laws in 2015 to focus on civil rather than criminal penalties, JP courts have authority to order students and parents to participate in counseling, attend special classes, perform community service, and access other interventions (Texas Family Code Chapter 65). Done right, this can be an opportunity to connect families with services that address underlying problems—not just punish them for symptoms. But these tools only work when school districts properly refer cases in the first place.<h2>My Vision for JP1</h2>I believe JP1 can do more than process truancy cases—we can be a gateway to real help. Working with schools, mental health providers, and community organizations, we can ensure families get connected to resources that address the real reasons kids aren't attending school. I will also work to ensure school districts are following proper referral processes so that students who need intervention actually reach the court. We should also track our own outcomes: Are the interventions we order actually working? Are students returning to school? Are families getting the support they need? <h2>There's More to It</h2>You might think that when a gavel falls on a court case, that's all there is to it. But true justice requires more—more to ensure whatever brought someone to court doesn't happen again. We cannot just hand down dispositions—fines, community service, court costs—without connecting people to the resources that could help them avoid returning. This approach fails everyone: it doesn't serve justice, it doesn't help people get back on their feet, and it wastes the court's time with repeat appearances.<h2>JP1's Unique Position</h2>JP Precinct 1 has consistently maintained one of the lowest caseloads among El Paso County's Justice of the Peace courts—a pattern documented in more than a decade of Texas Office of Court Administration data (<a href="https://card.txcourts.gov/ReportSelection.aspx" target="_blank" rel="noopener noreferrer">Texas OCA Justice Courts Activity Detail</a><a href="https://card.txcourts.gov/" target="_blank" rel="noopener noreferrer">)</a>. Despite all JP precincts serving roughly equal populations—approximately 107,000-111,000 residents after the 2021 redistricting based on Census data (<a href="https://www.epcounty.com/redistricting/documents/Commission%20Report%2010182021.pdf" target="_blank" rel="noopener noreferrer">Redistricting Commission Report, 10/18/2021</a>)—JP1's caseload remains substantially smaller than other precincts.This pattern raises two important ideas:First, the opportunity:&nbsp;JP1's manageable workload means we actually have time to implement innovative approaches.Second, the concern:&nbsp;A low caseload doesn't mean disputes don't exist in our community—it may mean residents aren't accessing the court, aren't aware of their rights, or aren't being properly referred by institutions like school districts.<h2>Connect People to Solutions</h2>When someone comes before JP1 with a debt issue, rental dispute, or other problem, their case often signals an underlying challenge: unemployment or underemployment; mental health or social-emotional needs; lack of knowledge about landlord, tenant or consumer rights; or financial instability. JP cases can be seen as the canary in the social coal mine—what appears here is likely a sign what might follow without intervention.I will explore partnerships with alternative dispute resolution options, employment services, mental health providers, and legal aid to connect people with support they need. This approach is inspired by programs like the El Paso County Promise (<a href="https://www.epcounty.com/promise/" target="_blank" rel="noopener noreferrer">epcounty.com/promise</a>), which demonstrates how connecting people to resources creates better outcomes for everyone.This could mean:• Offering mediation for disputes to avoid additional court costs• Connecting people facing fines with workforce programs and offering meaningful community service options• Recommending those who need mental health and substance abuse treatment the services El Paso can provide• Ensuring people know about legal aid resources for civil matters<h2>Address the Root Cause</h2>It's just practical, and research confirms this. The U.S. National Institute of Justice reports that 'increasing the severity of punishment does little to deter crime' and that 'prisons may exacerbate recidivism.' A Texas study found drug courts reduced re-arrest rates by 34% compared to traditional prosecution. Programs addressing underlying problems consistently outperform punishment-only approaches (<a href="https://nij.ojp.gov/topics/articles/five-things-about-deterrence" target="_blank" rel="noopener noreferrer">NIJ, 2016</a>;&nbsp;<a href="https://www.ojp.gov/ncjrs/virtual-library/abstracts/initial-process-and-outcome-evaluation-drug-courts-texas" target="_blank" rel="noopener noreferrer">Texas Criminal Justice Policy Council, 2003</a>).I will also prioritize&nbsp;community outreach&nbsp;to ensure JP1 residents know what the court does and how to access it. If our caseload is low because people don't know they have legal recourse, that's a failure we can fix.
